01 Introduction and Acceptance
These Terms of Service (“Terms”) govern access to and use of TRAXE Forms, including its websites, applications, workspaces, form-building tools, data collection services, data processing capabilities, analytics, research functionality, artificial intelligence services, integrations, and related products and services (collectively, the “Services”).
By creating an account, accessing the Services, purchasing a subscription, or using the platform on behalf of an organization, you agree to these Terms. If you act on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
If you do not agree, you must not use the Services.
Additional agreements, including subscription orders, data processing agreements, enterprise contracts, and service-specific terms, may apply. Where there is a conflict, the applicable signed agreement takes precedence to the extent specified in that agreement.

Applicable Law: Laws and regulations applicable to the relevant party, activity, jurisdiction, and data processing.
03 The Services
TRAXE Forms provides a platform for creating and managing digital forms and structured data workflows.
The Services encompass form design and publication, response collection, invitations, collaboration, data import and export, validation, data transformation, dashboards, statistical and research analysis, reporting, AI-assisted workflows, integrations, and related information-management capabilities.
Certain capabilities may be subject to subscription entitlements, usage allowances, technical requirements, separate contractual arrangements, or service-specific restrictions.
TRAXE Forms may improve, modify, replace, or discontinue functionality, subject to applicable contractual commitments and reasonable notice where required.
04 Accounts and Eligibility
Users must provide accurate registration information and maintain the security of their accounts.
Customers are responsible for managing Authorized Users, assigning appropriate permissions, protecting credentials, and promptly reporting suspected unauthorized access.
Users must not share credentials in ways that undermine account security or circumvent access controls.
The Customer is responsible for activity conducted under its accounts, except to the extent caused by TRAXE Forms' breach of its obligations or other circumstances for which responsibility cannot lawfully be allocated to the Customer.
Users must meet the legal age and capacity requirements applicable to entering into the relevant agreement. Use involving children or other protected populations requires appropriate authorization and safeguards.
05 Customer Data and Ownership
As between the Customer and TRAXE Forms, the Customer retains its rights, title, and interests in Customer Data.
Customers grant TRAXE Forms a limited right to host, transmit, process, reproduce, transform, display, and otherwise handle Customer Data as reasonably necessary to provide the Services, comply with lawful instructions, maintain security, and fulfill contractual obligations.
This permission does not transfer ownership of Customer Data to TRAXE Forms.
Customers are responsible for ensuring that they possess the necessary rights, notices, authorizations, and lawful bases to collect, upload, import, share, analyze, and otherwise process Customer Data.
Where multiple customers or individuals have competing interests in particular data, access, transfer, export, modification, or deletion may require additional authorization or review.
06 Forms, Surveys, Research, and Respondent Data
Customers determine the purposes, questions, collection methods, target participants, access conditions, and appropriate use of their forms and datasets.
Customers are responsible for:
- Providing legally required privacy notices and obtaining valid consent or another lawful basis where applicable.
- Ensuring the proportionality, accuracy, and appropriateness of collected information.
- Applying appropriate safeguards to sensitive, confidential, or regulated information.
- Respecting respondent rights and applicable research ethics.
- Establishing lawful retention and deletion practices.
- Securing necessary institutional, professional, or ethics approvals.
TRAXE Forms does not independently validate the legal, ethical, scientific, or regulatory suitability of every Customer-created instrument or research activity.
The Customer remains responsible for interpreting results and decisions made using information collected through the Services.
07 Collaboration and Access Control
Customers may invite personnel, researchers, enumerators, administrators, consultants, or other collaborators to participate in authorized workspaces and projects.
Customers are responsible for managing collaborator permissions and ensuring that access is limited to legitimate operational requirements.
Authorship, contribution, participation, or access to a workspace does not automatically transfer ownership of the underlying data or provide authority to delete another party's records.
The Services may preserve records necessary for accountability, security, auditability, and lawful administration.
08 Data Import, Export, and Integrations
Customers may import datasets from external sources and export information into supported formats or connected services.
Customers warrant that they have the necessary rights and authorizations for information imported into the Services.
TRAXE Forms is not responsible for the accuracy, legality, availability, or security of external systems independently operated by third parties, except to the extent required by law or expressly agreed.
Customers should review the terms and privacy practices of connected third-party services.
Exports may contain sensitive information and must be handled, distributed, stored, and retained securely by the receiving party.
09 Artificial Intelligence and Automated Analysis
AI Services may assist with form design, question generation, data preparation, interpretation, statistical analysis, research, reporting, and related workflows.
AI-generated material may contain inaccuracies, omissions, biases, or unsuitable recommendations. Customers must independently evaluate outputs before relying on them, especially for legal, medical, financial, scientific, employment, educational, or other consequential decisions.
Customers remain responsible for their instructions, the information submitted to AI Services, and their decisions based on outputs.
TRAXE Forms may use internal models, third-party AI service providers, or a combination of technologies under applicable service arrangements.
The applicable Privacy Policy, Data Processing Agreement, and service-specific disclosures govern the processing of personal information through AI Services.
AI Services do not replace professional judgment, peer review, research ethics approval, or other required human oversight.
Ownership and permitted use of AI outputs are subject to applicable law, third-party rights, and the relevant service terms.
10 Statistical, Research, and Analytical Results
The Services may offer descriptive and inferential statistics, visualizations, data transformation, qualitative analysis, research tools, forecasting, and related analytical capabilities.
Analytical outputs depend on the quality, completeness, representativeness, and suitability of the underlying data and methods.
Customers are responsible for determining whether statistical assumptions are met, interpreting results correctly, and seeking appropriate methodological or professional review.
TRAXE Forms does not guarantee that an analysis establishes causation, statistical significance, scientific validity, or suitability for a particular decision.
11 Acceptable Use
Users must not use the Services to:
- Violate applicable laws or the rights of others.
- Conduct fraud, phishing, harassment, unauthorized surveillance, or unlawful data collection.
- Distribute malware or interfere with platform security.
- Obtain unauthorized access to accounts, data, networks, or systems.
- Collect or disclose personal information without appropriate authority.
- Circumvent subscription limits or security controls.
- Infringe intellectual property or confidentiality rights.
- Generate or distribute unlawful or materially harmful content.
- Misrepresent research results, respondent identities, or the source of collected information.
TRAXE Forms may investigate suspected violations and take proportionate action, including restricting access, suspending affected functionality, or terminating accounts, subject to contractual and legal requirements.
12 Subscriptions, Fees, and Usage
Subscriptions and other paid services are governed by the pricing, billing intervals, usage entitlements, and payment conditions presented at purchase or specified in an applicable agreement.
Charges may relate to subscription tiers, storage, submissions, collaborators, enumerators, AI usage, processing resources, or other defined consumption metrics.
Customers are responsible for applicable fees and taxes, except taxes assessed on TRAXE Forms' own income.
Changes to subscription pricing, renewal arrangements, and usage entitlements will be communicated as required by applicable law and the governing agreement.
Refunds, cancellations, trials, and renewals are subject to the applicable order terms and mandatory consumer-protection rights.
13 Availability, Maintenance, and Support
TRAXE Forms aims to provide a reliable and secure service but does not guarantee uninterrupted or error-free availability unless expressly agreed in an applicable service-level agreement.
Maintenance, technical incidents, external dependencies, security events, or circumstances beyond reasonable control may affect availability.
Support and service commitments depend on the Customer's applicable service arrangements.
14 Confidentiality and Security
Each party must protect confidential information received from the other party using reasonable safeguards and may use it only for authorized purposes.
TRAXE Forms will maintain technical and organizational measures appropriate to the Services, the relevant data, and applicable contractual and legal obligations.
Customers must implement appropriate safeguards within their own accounts, systems, devices, integrations, and downloaded datasets.
Neither party may disclose confidential information except as permitted under the agreement, with authorization, or as required by law.
15 Privacy and Data Protection
Personal information is handled in accordance with the TRAXE Forms Privacy Policy, applicable Data Processing Agreements, and relevant data protection laws.
Depending on the activity, TRAXE Forms may act as an independent controller of account and business information or as a processor/service provider handling Customer-controlled data.
Customers remain responsible for their independent obligations as controllers or other legally designated parties.
International data transfers, subprocessors, security measures, and data subject rights are governed by applicable legal requirements and contractual arrangements.
16 Retention, Export, and Deletion
Customers may request data export, account closure, or deletion of eligible resources, subject to the Services' applicable procedures, ownership verification, security requirements, contractual obligations, legal holds, and lawful retention exceptions.
Deletion of information may require distinguishing customer-owned records from shared resources, respondent records, historical evidence, externally held copies, or information that must be retained by law.
Account termination does not automatically extinguish another party's rights or obligations concerning shared or independently controlled information.
Information may remain in restricted backups or legally required records for applicable retention periods, subject to appropriate safeguards.
Specific deletion timelines, mechanisms, and exceptions are governed by the applicable Privacy Policy, Data Processing Agreement, and approved retention arrangements.
17 Intellectual Property
TRAXE Forms and its licensors retain all rights in the Services, software, interfaces, documentation, trademarks, and associated intellectual property.
The Customer receives a limited, non-exclusive, non-transferable right to access and use the Services during the applicable subscription or authorized access period.
Nothing in these Terms transfers ownership of the platform's underlying software or technology.
Customers retain ownership of their original Customer Data, subject to applicable third-party rights.
Feedback voluntarily provided about the Services may be used to improve the platform, provided such use does not override applicable confidentiality or data protection obligations.
18 Third-Party Services
The Services may interface with external payment providers, cloud infrastructure, authentication services, analytics tools, AI providers, and other third-party systems.
Separate third-party terms may apply when Customers independently engage those services.
TRAXE Forms' responsibility for third-party processing undertaken on its behalf is governed by applicable law and contractual commitments.
19 Suspension and Termination
TRAXE Forms may suspend or restrict access where reasonably necessary to protect security, prevent unlawful activity, address serious contractual violations, or comply with legal obligations.
Where appropriate and lawful, advance notice and an opportunity to remedy violations will be provided.
Customers may discontinue use or terminate subscriptions in accordance with their applicable contractual arrangements.
Following termination, access, export, retention, and deletion are governed by the applicable agreement and lawful obligations.
Provisions intended by their nature to survive termination will continue to apply.
20 Warranties and Disclaimers
Each party represents that it has the authority to enter into and perform its obligations under these Terms.
Except for express warranties and protections that cannot lawfully be excluded, the Services are provided subject to the limitations specified in the applicable agreement.
TRAXE Forms does not warrant that Customer-created instruments, imported data, analytical findings, or AI-generated outputs are accurate, complete, or appropriate for every intended purpose.
Nothing in these Terms excludes mandatory statutory warranties or consumer rights.
21 Limitation of Liability
Liability provisions remain under legal review. This preview does not establish an approved liability cap, exclusion, or other contractual limit.
22 Indemnification
Indemnity provisions remain under legal review. This preview does not create an indemnity obligation or claim procedure.
23 Governing Law and Dispute Resolution
The governing-law and dispute-resolution provisions remain under legal review. This preview does not select a governing law, court, arbitration forum, or dispute procedure.
24 Changes to These Terms
TRAXE Forms may update these Terms to reflect changes in law, products, security, or business practices.
Material changes will be communicated in accordance with applicable legal and contractual requirements.
Where legally required, fresh acceptance or another valid legal basis will be obtained before amended terms take effect.
25 General Provisions
If any provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law.
Failure to enforce a provision does not constitute a waiver.
Neither party may assign its material rights or obligations except as permitted by the applicable agreement and law.
These Terms, together with incorporated agreements and applicable orders, constitute the governing agreement for the Services within their stated scope.
26 Contact
The service-provider identity, legal notice address, and official contact details remain to be confirmed. This preview does not establish a legal notice contact.
